Erica, 36, was served the papers at her Florida home on May 13 and had the standard 20-day window to respond. However, she missed Sunday’s deadline and hasn’t filed any response since, confirmed an official with the Palm Beach County Clerk’s office.
This lapse leaves Erica, the mother of McIlroy’s three-year-old daughter Poppy, vulnerable to a default divorce. If a default is granted, the court can proceed without her participation, denying her a chance to contest McIlroy’s petition, which describes their seven-year marriage as “irretrievably broken.”

McIlroy was in Kentucky for the PGA Championship when the summons was delivered to Erica at their Jupiter mansion. His petition seeks shared custody of their daughter and enforcement of their prenuptial agreement signed before their 2017 wedding. The papers, served by Carl Woods, a Palm Beach cop and process server, warned Erica to file a written response within 20 days or risk losing the case and potentially having her wages, money, and property taken without further court notice.
The documents advised Erica to consider hiring an attorney, but none is currently assigned to her case.

McIlroy, with nearly $87 million in PGA Tour earnings, met New York native Erica during the 2012 Ryder Cup while she was working for the PGA of America. She helped him make his tee time at Medinah in Illinois after he missed his alarm. They began dating months after McIlroy called off his engagement to tennis star Caroline Wozniacki in 2014.
A source close to the tour claims McIlroy is “super focused on golf” as he seeks another major win after a decade. “He put his blood, sweat, and tears into defending the PGA against LIV golf the last two years, and it was basically for nothing,” the source told People. “He’s just trying to find himself, focus, and get back to winning.”
The couple’s divorce filing calls for shared custody and a parenting plan for their four-year-old daughter, Poppy.
